CLINIMED warrants that all CLINIMED instruments, either stamped, etched or laser marked with the CLINIMED name shall be free from manufacturing defects in material and/ or workmanship for the life of the instrument. This warranty will remain in effect as long as the instrument or product is used for its intended surgical or dental purpose as well as continuous and proper care of the instruments/ products is maintained.

Our eminent responsibility under this warranty shall be, at CLINIMEDS’ option, to either repair or replace any instrument proving defective. Should CLINIMED repair technicians determine that a CLINIMED branded instrument is beyond repair, it will be replaced at no charge.

The following CLINIMED products have limited warranties:

Tungsten carbide Scissors > 5 years
Tungsten Carbide Needle holders > 1 year
Diamond Dust instruments > 1 year
Titanium instruments > 3 years
Electrosurgical instruments > 3 years

Laser surgery instruments > 3 years
Silver or Chrome plated instruments > 1 year
Fiber optic instruments > 1 year
Super-cut scissors > 1 year
Liposuction cannulas > 1 year

The above warranties are contingent upon proper maintenance and use of the instruments and do not cover instruments that have been modified without CLINIMEDS’ approval, or which have been subjected to unusual stress, or on which the original identification marks have been removed or altered. Repairs or modifications performed by unauthorized personnel will void all product warranties and could affect the performance and efficacy of the device.

No warranty or guarantee may be created by any act or statement; the above written warranty is the total and exclusive warranty CLINIMED makes. No warranty may be modified in any way, except as a result of a contract signed by an officer of CLINIMED. These limitations on the creation and modification of any warranty may not be waived or modified orally or by any conduct.

Exclusion of Other Warranties and Remedies
The above warranty is a limited warranty, and it is the only warranty made by CLINIMED. CLINIMED makes no warranty, express or implied, and there is expressly excluded all warranties of merchantability and fitness for a particular purpose. CLINIMED shall have no liability for consequential, exemplary or incidental damages even if it is aware of the possibility of such damages. The stated express warranty is in lieu of all liabilities or obligations of CLINIMED arising out of, or in connection with, the delivery, use or performance of the equipment.

Limitation of Liability for Damages
CLINIMED, INC. shall not in any case, be libel for direct, indirect, special, incidental or consequential damages arising from breach of warranty, breach of contract, negligence, or any other legal theory. Such damages include but are not limited to, loss of profits or revenues, loss of use of the product or any associated equipment, cost of capital, cost of any substitute product, facilities or services, down-time costs, or claims of customers for such damages.

Repair Warranty
If for any reason a customer is dissatisfied with a CLINIMED repair, we guarantee to replace or again repair the product at no additional charge if returned within 30 days.

Warranty Stipulations
The above warranties are effective from the original date-of-purchase from either and only from CLINIMED or an Authorized CLINIMED partner. The above warranties are only valid for original point of purchase of CLINIMED products, and are non- transferrable. Instrument designs and patterns may change without prior notice.
